4. Filing a DMCA Takedown Notice

If you believe that your copyrighted work has been copied and is accessible on New Salon in a way that constitutes copyright infringement, please send a written notification to our Designated Agent containing the following information:

4.1 Required Information

Physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest.
Identification of the copyrighted work claimed to have been infringed. If multiple works at a single online site are covered by a single notification, provide a representative list.
Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (e.g., the URL(s) where the material appears).
Your contact information: Name, address, telephone number, and email address.
A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright.

4.3 What Happens After We Receive Your Notice

Upon receipt of a valid DMCA notice, we will:

Acknowledge receipt of your notice
Review the notice for completeness and validity
Remove or disable access to the allegedly infringing material
Notify the user who posted the material of the takedown
Provide the user with information about how to file a counter-notification

5. Counter-Notification Procedure

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with our Designated Agent.

5.1 Required Information for Counter-Notification

Your counter-notification must contain:

Your physical or electronic signature.
Identification of the material that has been removed or to which access has been disabled and the location where the material appeared before it was removed or disabled.
A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
Your name, address, and telephone number.
A statement that you consent to the jurisdiction of the federal court in your judicial district (or Berlin, Germany if you are outside the United States) and that you will accept service of process from the person who provided the original DMCA notification.

5.2 What Happens After Counter-Notification

If we receive a valid counter-notification, we will:

Forward a copy to the original complainant
Inform them that the removed material may be restored in 10-14 business days
Restore the material unless the copyright owner files a court action within 10-14 business days

6. Repeat Infringer Policy

It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers.

6.1 Definition of Repeat Infringer

A user is considered a repeat infringer if:

They have been the subject of more than two valid DMCA takedown notices
They have not successfully challenged these notices through counter-notifications
They have continued to post infringing material after receiving warnings

6.2 Consequences

Users identified as repeat infringers will have their accounts permanently terminated. This termination is at our sole discretion and no refunds will be provided.

7. Misrepresentation Warning

Important: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents:

That material is infringing, or

That material was removed or disabled by mistake

may be subject to liability for damages, including costs and attorneys' fees incurred by the alleged infringer, the copyright owner, or the service provider.

Please consider whether the use may be permitted as "fair use" before filing a notice.

8. European Union Notice

For users in the European Union, this policy also applies to notifications under Directive 2019/790 (Copyright in the Digital Single Market) and national implementations thereof.

If you are a rights holder in the EU and wish to report copyright infringement, please follow the same procedure outlined above. We will process your request in accordance with applicable EU law.

9. Modifications to This Policy

We reserve the right to modify this policy at any time. Changes will be effective immediately upon posting the updated policy on our website. Your continued use of the Service after any modifications indicates your acceptance of the updated policy.
